This set of terms applies to Basefund (basefund.uk), provided by Polycorp Ltd. See also the Privacy Policy.
These terms govern your use of the Polycorp website and products (together, "our services"). By using a service, you agree to these terms. If you do not agree, please do not use it.
1. About us
Our services are provided by Polycorp Ltd ("Polycorp", "we", "us"), a limited company registered in England and Wales under company number 14957566. You can contact us at [email protected].
2. Who can use our services
You must be at least 18 years old, or at least 13 with the permission of a parent or guardian who agrees to these terms on your behalf. If you use a service on behalf of an organisation, you confirm you have authority to accept these terms for it.
3. Your account
Some services require an account. You agree to give accurate information, keep your login details secure and tell us promptly if you think someone else has accessed your account. You are responsible for activity under your account unless it results from our failure to keep it secure.
4. Acceptable use
You agree not to:
- break the law, or use a service to help anyone else do so;
- infringe anyone's intellectual property or privacy;
- upload malware or anything designed to disrupt, damage or gain unauthorised access to our systems or other users' data;
- probe, scrape or overload our services beyond normal use, or try to get around security or usage limits;
- resell or provide access to a service to third parties without our permission;
- harass, abuse or harm others.
5. Your content
You keep ownership of the content you create or upload. You give us a limited licence to host, store, process and display that content only as needed to provide the service to you. This licence ends when you delete the content or your account, except where we need to keep copies for legal reasons or in routine backups for a limited time.
You are responsible for making sure you have the right to use any content you provide.
6. Our intellectual property
The services, including their software, design, text, names and logos, belong to Polycorp Ltd or our licensors. We grant you a personal, non-exclusive, non-transferable right to use the services in line with these terms. You may not copy, modify, distribute or reverse-engineer them except where the law allows.
7. Fees and subscriptions
Where a product charges, the price and billing terms are shown before you pay. Subscriptions renew automatically until cancelled, and you can cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing period.
If you are a consumer, you have a 14-day right to cancel a new purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start providing a digital service during that period, you may be charged for the part already supplied.
8. Changes and availability
Our products are actively developed. We may change, suspend or withdraw features or a whole service. We will try to give you reasonable notice of significant changes, and where you have paid for something we withdraw, we will give you a fair refund for the unused part. We do not promise that a service will always be available or free from errors.
9. Suspension and termination
You can stop using a service and close your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. Where reasonable, we will tell you first and give you the chance to export your content.
10. Your statutory rights
Nothing in these terms affects your legal rights as a consumer, including under the Consumer Rights Act 2015. Digital content and services we provide must be as described, fit for purpose, of satisfactory quality and provided with reasonable care and skill. Beyond those rights, our services are provided "as is".
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, for business losses (such as lost profit or business interruption), or for loss caused by events outside our reasonable control.
Where the law permits, our total liability to you for any claim is limited to the amount you paid us for the relevant service in the 12 months before the claim, or £100 if greater.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
12. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. If we make significant changes, we will tell you through the service or by email before they take effect. If you keep using the service after that, the updated terms apply.
13. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
